Safety Terms and Guest Declaration

It is essential that you (the client or traveller) read and understand the terms and conditions that we (Simply Wild Ltd) set out below. We require each participant read and agree with these terms and conditions before commencement of the trip.

Adventure tourism provides thrills. These involve the perception of risk. Risk taking activities expose you to the danger of accidents. While we try to manage risk, we can't exclude it without taking away the thrills.

Responsibility
You agree to accept the authority of our guides and the guides of our contractors at all times.
Adults accompanying any person under the age of 18 must ensure that the underage person follows our instructions at all times.
We will not accept any liability if you contravene any New Zealand or local law or regulation.
You accept that we reserve the right to remove you from the trip for any breaches of these terms and conditions, with no right of refund.
You recognise that there are inherent risks in the activities undertaken, and the use of the means of transport and equipment provided on the trip, and you assume personal responsible for your actions during the trip. We will not be liable for any claims against us caused through your actions.

Information collected
When you supply us with personal information we will only provide to our contracted service providers, and where necessary local or national authorities, information which is required by them to operate or meet legal requirements.

Medical form
If you have pre-existing medical conditions, you must be satisfied that you are able to participate fully on the trip. Any medical issues we need to know of must be recorded on a medical form (available from our guide) before commencement of the trip.

Exclusion
To the extent permitted by law, all our liability for damage to your property, person, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.

By paying the tariff and taking part in the trip, you agree both: to indemnify Simply Wild against liability to other parties; and to release Simply Wild from liability where the liability results from either: your failure to follow our instructions; or your reckless act.
